Terms of Service
Effective date: April 15, 2026
These Terms of Service ("Terms") govern your access to and use of the LapseCloud website at lapsecloud.com and the client portal at app.lapsecloud.com (collectively, the "Service"), operated by LapseCloud ("we," "us," or "our").
By registering for an account, submitting an onboarding form, or accessing the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
LapseCloud provides construction site timelapse photography and monitoring services, including automated syncing of client-captured photos to a secure online portal, timelapse video generation, and site progress comparison tools.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
2. Accounts and Access
- You must provide accurate information when registering and keep your credentials confidential.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at info@lapsecloud.com if you suspect unauthorised access.
- Accounts are non-transferable. Do not share login credentials with third parties.
- We may suspend or terminate accounts that violate these Terms.
3. Trial Period
New clients may be offered a 14-day free trial (Starter Monthly plan). No payment is required during the trial. At the end of the trial, the Service will be suspended unless a paid subscription is activated. Activation is a manual step confirmed by both parties — we do not automatically charge your payment method at the end of a trial.
4. Subscriptions and Payment
- Subscriptions are billed monthly or annually as selected at purchase.
- Payments are processed through PayPal. By subscribing, you agree to PayPal's terms and conditions.
- Subscription fees are charged in advance for each billing period.
- All prices are listed in USD unless stated otherwise.
- We reserve the right to change prices with at least 30 days' notice. Continued use after a price change constitutes acceptance.
- Taxes, if applicable, may be added to invoices and are your responsibility.
5. Cancellation and Refunds
- You may cancel your subscription at any time by contacting info@lapsecloud.com.
- Cancellation takes effect at the end of the current billing period. You retain access until that date.
- We do not provide pro-rated refunds for partial billing periods.
- Refunds may be issued at our sole discretion in exceptional circumstances (e.g. prolonged outage caused by us).
- Upon cancellation, your data is retained for 30 days then permanently deleted, unless earlier deletion is requested.
6. Hardware and Camera Setup
Since LapseCloud clients install their own cameras:
- You are responsible for the camera hardware, its installation, and providing reliable power and internet connectivity.
- You are responsible for complying with applicable surveillance and photography laws at your site, including posting required notices.
- We provide FTP credentials and setup guidance, but are not responsible for damage, theft, or malfunction of client-owned equipment.
7. Your Content
- You retain ownership of all photos and videos captured at your site ("Your Content").
- You grant us a limited, non-exclusive licence to store, process, and display Your Content solely to provide the Service.
- We will not share, sell, or publicly display Your Content without your explicit written consent.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable law.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
- Reverse engineer, decompile, or extract source code from the Service.
- Upload or transmit malicious code or harmful content.
- Resell or sublicense the Service to third parties without our written consent.
- Use automated bots or scripts that place excessive load on our systems.
9. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages (Supabase, Netlify, cloud providers), or unforeseen technical issues may occasionally affect availability. We are not liable for losses caused by interruptions beyond our reasonable control.
10. Video Generation
Timelapse video generation is processed on our servers and may take several minutes depending on image count and server load. We do not guarantee specific processing times. Video generation limits per project per month may apply depending on your subscription plan.
11. Intellectual Property
All software, interfaces, branding, and content comprising the Service (excluding Your Content) are the intellectual property of LapseCloud. Nothing in these Terms grants you the right to use our trademarks, logos, or brand elements without prior written consent.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind.
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
- Our total aggregate liability for any claim shall not exceed the total fees paid by you in the 3 months preceding the claim.
- We are not responsible for data loss caused by events outside our control.
13. Indemnification
You agree to indemnify and hold LapseCloud harmless from any claims, losses, damages, or expenses arising from: (a) your use of the Service in violation of these Terms; (b) Your Content; (c) your failure to comply with applicable surveillance or privacy laws at your site.
14. Termination
Either party may terminate the agreement at any time. We may suspend or terminate your access immediately and without notice if you materially breach these Terms, fail to pay subscription fees, or engage in conduct harmful to the Service or other users.
15. Governing Law and Disputes
These Terms are governed by the laws of Israel. Any disputes will be subject to the exclusive jurisdiction of the courts of Israel. Local mandatory consumer protection laws may apply in addition where required by your jurisdiction.
16. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected in the effective date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
